TERMS AND DEFINITIONS

Contractor - Limited Liability Company "National Center for Genetic Research" (LLC "NTsGI", BIN 1115476164814, TIN 5402545966), carrying out research activities in the field of genetics and providing the service "DNA-Testing MYGENETICS" to Customers.

Customer and / or Client is an individual fully capable in accordance with Russian law, who has accepted (accepted) this offer under the following conditions.

Genetic testing service, DNA testing of MyGenetics, genetic test - a service for analyzing genetic information from provided samples of buccal epithelium (genetic material), interpreting the results of analyzing genetic information and providing the results of such analysis in the form of Personal DNA report.

The package of services may also include personal consultation with a nutrition specialist and / or a client management program by a nutrition specialist.

Set for carrying out "DNA TESTING of MYGENETICS", set for carrying out genetic testing or set for testing - a set completely approved by the Contractor, intended for independent collecting of a genetic material by the Customer with the instruction for application . The test kit is the property of the Contractor and is transferred to the Consumer for the purpose of its subsequent transfer to the Contractor for the purpose of conducting research.

The Contractor's Website or the Website is the Contractor's electronic information resource located on the Internet at www.mygenetics.ru , providing the Customer with information about the Contractor's services and the Genetic Test online service, providing the Genetic Test service, including processing and paying for the rendering order services, creating a personal account, online support for the Customer, uploading and storing a report with the results of the study.

Personal information - information provided by the consumer in writing on the site www.mygenetics.ru in order to register a user and create, including filling in sections, a personal account on the site. As well as information provided by the Consumer in writing (filling out a questionnaire) in order to provide the Service and prepare the report by the Contractor.

The Contractor's Report is a report with the results of the study, prepared by the Contractor in electronic writing, containing the results of a comparison of the nucleotide polymorphism alleles of the genetic material provided by the Customer with the results of the scientific research in the field of human genetics. The report does not contain information about the state of health of the Customer, including the diagnosis and / or prognosis of the Customer's state of health. For information on the state of health and diagnosis, as well as to obtain the necessary medical care, the Customer should consult a doctor and undergo a medical examination at a medical organization.

Certificate MyGenetics or Certificate - gives the right to reduce the cost of services for the analysis of genetic information by an amount equal to the nominal value of the Certificate. Validity of the Certificate is 55 days from the date of its purchase by the Customer. Upon expiration of this period, the validity of the Certificate becomes invalid.

1. General provisions

1.1. This document is a public offer (Article 437 of the Civil Code of the Russian Federation) of the Contractor addressed to an unlimited circle of capable individuals and contains all the essential conditions for the provision of genetic testing services to the Customer by the Contractor.

1.2 The Genetic Test service and the Genetic Test online service on the website
www.mygenetics.ru was created and used by the Contractor for the purpose of conducting scientific research on impersonal genetic information and organizing the participation of the Customer in research on a commercial basis. The service The genetic test is not a method of prevention, diagnosis, treatment, medical rehabilitation; the information provided to the Customer on the result of the provision of the Service information (Report) cannot be used to establish the diagnosis, prescribe treatment or prevent diseases, or medical rehabilitation.

1.3 The services rendered by the Contractor to the Customer are necessary for the Customer exclusively for personal, family, home and other needs not related to the business.
1.4 By paying the cost of the DNA test kit ordered on the Site , the Customer thereby unconditionally accepts the terms of this offer. The Contractor guarantees that it has the necessary right - and capacity to enter into and execute the Agreement.

1.5 The Contractor has the right at any time to change the list of services and the terms of this agreement unilaterally without prior approval from the Customer, while ensuring the publication of the amended terms on the Internet resource at www.mygenetics.ru . Such changes come into force from the moment of their publication.

2. The procedure for the provision of services

2.1 To receive the Genetic Test service, the Customer must:

2.1.1 Select at the Contractor's site www.mygenetics.ru best for themselves on the content of the analyzed factors and scope of DNA-test kit

2.1.2 Register on the website of the Contractor www.mygenetics.ru;

2.1.3 Pay for the Cost of the selected DNA test kit indicated by the contractor on the site www.mygenetics.ru

The provision of genetic testing services is carried out on the terms of full prepayment.

Payment for services of the Contractor is carried out by the Customer in rubles by any of the methods indicated on the Site. The moment of payment is recognized cash flow to the account of the Contractor.

In case of non-receipt of the payment made by the Customer through the Site, to the bank account of the Contractor, the provision of the Service is suspended, and the Customer is notified by the email address provided by the Customer when placing the order.

Cost of service Genetic test. The Contractor is entitled, without any notification and additional information, or with such, to carry out advertising campaigns by providing participants with such shares certificates, promotional codes, discount coupons and other marketing tools entitling them to purchase the Service at a reduced price.

2.1.4 Activate access to the Personal Account , sent by the Contractor to the Customer's email address (specified by the Customer when registering on the Site) after full payment by the Customer of the cost of the selected DNA test kit.

2.1.5 Collect samples of genetic material, accurately following the instructions for collecting genetic material, in an amount sufficient to provide services to the Contractor.

2.1.6 Fill out the form and agree in writing to consent to the processing of personal data , complete and sign the consent form with your own hand. In case of non-compliance with the terms of this clause, the Contractor shall have the right to refuse to provide the Service to the Customer.

2.1.7 Transfer to the Contractor samples of genetic material, a questionnaire and signed Informed Consent at the address indicated on the site. The customer, at his own discretion, chooses the method and transport company for the delivery of genetic material and informed consent to the Contractor. Delivery is paid by the Customer additionally.


2.2 The Contractor, when rendering services, has the right to attract co-contractors without any approvals and notifications from the Customer.

2.3 In the Personal Account on the website of the Contractor, the Customer can track the stages of the execution of his order.

2.4 The report of the Contractor with the results of the research conducted by the Contractor is placed in the Customer's Personal Account on the website www.mygenetics.ru , and a notification is sent to the Customer's email address specified during registration on the Site. The report is available for download in electronic form, in a file with PDF extension.

2.5 The term of the service is 30 (thirty) working days from the date of receipt by the Contractor of the genetic material, signed consent to the processing of personal data and a completed questionnaire from the Customer. The contractor is entitled to provide the service ahead of time.

2.6 Services are considered to be rendered in full and with proper quality, in the absence of written objections or claims from the Customer within 5 (five) calendar days from the date of placement by the Contractor of the report on the results of genetic research, which is equivalent to the signing of the Service Act by the Customer. At the same time, the signing of an additional act of acceptance and transfer of services rendered is not required. If claims arise, the Customer should send them to the customer service department at help@mygenetics.ru.

2.7 The Customer has the right to refuse the service ordered and paid for by him within 7 (seven) days from the date of payment if the envelope with the samples of genetic material has not yet been delivered to the Contractor's laboratory. In this case, the refund fee will be deducted from the refund amount in the amount of 50% of the amount of the paid order. To start the return procedure, you must contact the customer service department at help@mygenetics.ru.

2.8 When paying for a DNA test kit that includes a personal consultation of a nutrition specialist and / or a nutrition specialist's program (carried out via the online consultation service, the duration is indicated in the Service List on the Site), the Customer must complete the questionnaire available in the Personal Account on the Site. Online consultation is carried out by the Contractor during the Contractor's working hours.

3. Privacy and information security

3.1 Customer's personal data is processed by the Contractor in accordance with the Federal Law "On Personal Data" No. 152-ФЗ and the Policy regarding the processing of personal data of MyGenetics customers.3.2 When providing services, the Contractor ensures the confidentiality and security of the Customer's personal information. The contractor provides the depersonalization of the obtained genetic information of the Customer.

3.3 Filling in the NAME and E-mail fields, ticking the box: "I accept the terms of the agreement", the Customer thereby provides his Name and email address to the Contractor and agrees to the Contractor's processing of them, including in order to fulfill the Contractor's obligations under the public offer laid out on the Website: www.mygenetics.ru in case of acceptance by the Customer, promotion of services by the Service Provider, electronic and sms surveys, monitoring of the results of marketing campaigns, customer support, drawing prizes among Customers, monitoring of This is the level of the Customers, as well as the quality of services provided by the Contractor.

3.4 The customer has the right to refuse to receive advertising and other information without explaining the reasons for refusal by informing the Contractor of his refusal by calling +7 (800) 500-11-02, or by sending a corresponding application to the email address of the Contractor: help@mygenetics.ru. Service messages informing the Customer about the order and the stages of its processing are sent automatically and cannot be rejected by the Customer.

3.5 Filling out the form and consent form for processing personal data, the Customer thereby provides the Contractor with their personal data (last name, first name, gender, date of birth, height, weight, children age and regularity of sports (hours per week); contact information ( phone number, email address, address for delivery of correspondence); results of analysis of genetic material) and agrees to their processing by the Contractor in order to fulfill the Contractor's contractual obligations to the Customer.

3.6 The withdrawal of consent to the processing of personal data is carried out by withdrawing the acceptance of this Public Offer in form. Issued consent withdrawal should be sent to customer service by mailhelp@mygenetics.ru

3.7 The Contractor is not responsible for the information provided by the Customer on the Site in a generally accessible form (in comments and feedback).

3.8 The Contractor is entitled to record telephone conversations with the Customer. In this case, the Contractor undertakes to: prevent attempts of unauthorized access to information obtained during telephone conversations, and / or transfer it to third parties who are not directly related to the execution of the Services, in accordance with paragraph 4 of Art. 16 of the Federal Law "On Information, Information Technologies and Information Protection".

4. Final provisions.

4.1 All questions not expressly stated in this document are governed by the norms of the current legislation of the Russian Federation.

4.2 In case of failure to provide services due to the fault of the Contractor, the Contractor shall refund the funds paid by the Customer

4.3 Due to the fact that the services of the Contractor are knowledge-based in nature with the use of innovative research methods, the Contractor is released from liability for violation of the terms of service provision, if such a violation is caused by significant changes in the methodology or technology of service provision.

4.4 The customer is obliged to independently ensure the confidentiality of identifying information (login, password, etc.) for access to the Personal Account and is responsible for all actions performed using his login and password, carries the risk of adverse consequences associated with their loss. The Customer guarantees that he takes responsibility for all consequences that may arise as a result of his actions and / or access to his personal information of third parties, which also includes information about the genetic data of the Customer.

4.5 The Contractor shall not be liable for violation of the terms and conditions of the contract of offer if such violation is caused by the action of force majeure (force majeure), including: actions of state authorities, fire, flood, earthquake, other spontaneous actions, lack of electricity and / or malfunction of the computer network , strikes, civil unrest, riots, any other circumstances, not limited to those listed above, which may affect the implementation by the Contractor of the terms of this agreement and are not controlled by spolnitelyu.

4.6 The Contractor shall not be liable for losses incurred by the Customer, or another person related to the results of the research.

4.7 The extent of the possible liability of the Contractor in connection with the provision of the Service is limited to the compensation of direct actual damage and may not exceed the Cost of the Service.

4.8 The Contractor shall not be liable for the subjective perception by the Customer or other person of the results of the research conducted.

4.9 The Parties undertake to take all reasonable measures to resolve disputes and disagreements that may arise from this Offer Contract, or in connection with its execution through negotiations.

4.10 The parties agreed to comply with the preliminary claim dispute resolution procedure. The term for consideration of the claim may not exceed 60 (sixty) working days.

4.11 The claim is made in writing. The claim is accompanied by the documents necessary for the consideration of the claim, in which evidence of non-performance or improper performance of obligations under the contract must be submitted, and in the event of a claim for damages, information about the amount of damage caused. Complaints must be sent to the customer service department at help@mygenetics.ru.

4.12 If it is impossible to resolve any dispute through negotiation, after observing the complaint procedure, the dispute shall be considered in the arbitration court of Novosibirsk, in accordance with the procedure established by the legislation of the Russian Federation.

4.13 Recognition of any provisions of this Agreement as invalid, including by a court decision, does not entail invalidation of other provisions or the entire Agreement as a whole.

4.14 The parties to this Agreement recognize the validity of documents, the texts of which are received by fax and by e-mail, along with executed in simple written form. In the event of any disagreement, the Parties agreed to consider the certificates of the Archival Service of the Contractor to be authentic and final in order to resolve disagreements between the Parties.
